Is Kalshi legal? At the federal level, yes: Kalshi is an exchange licensed by the Commodity Futures Trading Commission, and it won the right to list election markets in court. The live question is sports. Several states say Kalshi’s sports contracts are illegal betting, federal appeals courts have split on who is right, and the dispute is now in front of the Supreme Court. This guide sets out where things stand, with dates, as of October 27, 2026.
The short answer
| Market type | Status |
|---|---|
| Economics, weather, finance, crypto | Legal nationwide under CFTC oversight; not the focus of state lawsuits |
| Elections | Legal after Kalshi’s 2024 court win against the CFTC; some states’ actions also cover politics contracts |
| Sports | Disputed: available in most states, but blocked or restricted in some by court orders |
Federal status
- November 2020: the CFTC designated KalshiEX as a contract market, the same federal licence as the big futures exchanges.
- September 2024: a federal judge in Washington, DC ruled that the CFTC had exceeded its authority in blocking Kalshi’s congressional-control contracts.
- May 2025: the CFTC dropped its appeal, leaving the ruling in place.
- 2026: the CFTC has backed exclusive federal jurisdiction, suing several states over their actions against prediction markets, and proposed a rule in June 2026 on which event contracts count as prohibited “gaming”.
The fight over sports contracts
Kalshi argues its sports contracts are federally regulated swaps, so state gambling laws don’t apply. States argue they are sports bets. Federal appeals courts have split:
| Court | Date | Result |
|---|---|---|
| Third Circuit (New Jersey) | April 6, 2026 | For Kalshi, 2–1: New Jersey blocked from enforcing its gambling law |
| Ninth Circuit (Nevada) | August 28, 2026 | Against Kalshi, 3–0: sports contracts likely bets, not swaps; Nevada may enforce. Kalshi has asked the full court to rehear |
| Ninth Circuit (California tribes) | September 16, 2026 | For the tribes: contracts traded on reservations likely gaming under federal Indian gaming law |
| Sixth Circuit (Ohio and Tennessee) | September 25, 2026 | Against Kalshi, 3–0: not swaps, and state law not preempted. Kalshi has asked the full court to rehear |
| Fourth Circuit (Maryland) | Argued May 2026 | Pending when we checked |
New Jersey has asked the Supreme Court to hear its case (Flaherty v. KalshiEX, No. 26-299). Kalshi’s response is due November 9, 2026, and the Court hadn’t decided whether to take the case when we checked.
Where sports contracts are restricted
Kalshi doesn’t publish a single list of restricted states, so check the app. Based on court orders and recent reporting:
- Nevada: a state court order bars Kalshi’s sports, election and entertainment contracts, and the Ninth Circuit ruled against Kalshi in August 2026. See Nevada.
- Michigan: a temporary restraining order in June 2026 was followed by a preliminary injunction on September 1 barring Kalshi’s sports contracts. See Michigan.
- Washington: a state court injunction from July 2026, amended in August, bars sports, politics and several other categories, while economics, finance and climate contracts remain. See Washington.
- Ohio and Tennessee: a Sixth Circuit panel ruled against Kalshi in September 2026, and Kalshi has asked the full court to rehear the case; Ohio says it will enforce its law. See Ohio.
- California tribal lands: see Is Kalshi legal in California?
Contested but available, as of late October 2026: Wisconsin, New York and others. Available with no state action: Pennsylvania, Georgia and Hawaii. Available under a truce with state regulators: Montana.
What it means for you
- State actions so far have mostly targeted sports, and in some states election and entertainment contracts; economics, weather and finance markets have been less affected.
- If you trade sports, availability can change at short notice. Kalshi typically closes or restricts markets in a state when a court order requires it.
- Kalshi is 18+ and verifies every customer’s identity. See Kalshi age requirement.
