What’s happened
- A company called Georgia Gambling Recovery LLC sued Kalshi, trying to use Georgia’s gambling-recovery law to claw back losses from Kalshi trading. In February 2026 the federal court in the Middle District of Georgia refused to send the case back to state court, finding it raised federal questions about Kalshi’s CFTC-regulated status.
- On May 18, 2026 the court paused the case for six months while related federal preemption questions develop. It doesn’t stop Georgia users from using Kalshi.
- A 2026 push to legalize sports betting failed in the Georgia House.

Why it matters
Georgia is one of the big states without legal sports betting, so prediction markets give Georgians a federally regulated way to trade on games that the state’s own law doesn’t offer. Any federal appeal from Georgia would go to the Eleventh Circuit. The national picture is in Is Kalshi legal?
