What’s happened
- In April 2026 Attorney General Josh Kaul sued Kalshi, Robinhood, Coinbase, Polymarket and Crypto.com, asking for their apps to be declared public nuisances and permanently barred from offering sports event contracts in Wisconsin.
- The CFTC sued Wisconsin to stop it. On July 29, 2026 Judge William Griesbach of the Eastern District of Wisconsin denied the CFTC a preliminary injunction, finding it unlikely to show sports event contracts are swaps and that Wisconsin’s gambling laws “are not preempted” by federal commodities law. That’s a preliminary ruling, and the CFTC said it will appeal.
- In August 2026 Novig sued Kaul in federal court, asking for a declaration that federal law preempts the state’s gambling laws. Underdog has also sued Wisconsin.
- Gov. Tony Evers signed a bill in 2026 legalizing sports betting placed on computer servers on tribal land, backed by all 11 of the state’s recognized tribes.

Why it matters
Wisconsin tests whether a state can keep enforcing its gambling laws when the CFTC itself sues to stop it. The state is in the Seventh Circuit, where a CFTC appeal would go. The national picture is in Is Kalshi legal?
