Is Kalshi legal in Washington State? Partly. Washington has some of the strictest gambling laws in the US, and in 2026 a state court ordered Kalshi to stop offering sports, election and several other kinds of contracts there, while economics and finance contracts can continue. What Washington has done
- December 9, 2025: the Washington State Gambling Commission said offering or participating in event-based contracts “is not authorized in Washington State”.
- July 2026: in a lawsuit brought by the state, a King County judge granted a preliminary injunction, finding Kalshi had likely violated the state’s Gambling Act and Consumer Protection Act.
- August 2026: an amended order barred Kalshi’s sports, elections and politics, entertainment and culture, tech and science, and “mentions” contracts in Washington, while exempting commodities, climate, economics and finance contracts. Kalshi had to geofence Washington users. The state Court of Appeals denied a stay.

Why Washington is different
Washington treats online gambling strictly, and its regulator took the position early that event contracts aren’t authorised. The state also sits in the Ninth Circuit, which ruled in August 2026, in a Nevada case, that sports event contracts are likely bets rather than federally regulated swaps.
